1. Entire agreement

These Terms constitute the entire agreement between you and Era Deals, superseding all prior agreements regarding the subject matter herein, including any previous versions of these Terms. By using our Services, including the website www.eradeals.com, you confirm that you are authorized to use the Services and agree to comply with these Terms and all applicable laws, rules, and regulations.

2. Modifications to services and terms

Era Deals reserves the right to modify or discontinue the Services, with or without notice, and shall not be liable to you or any third party for exercising this right. We may update these Terms at any time by posting changes on this page. Your continued use of the Services after such changes constitutes your agreement to be bound by the updated Terms.

3. Privacy policy and additional terms

Our Privacy Policy, which explains how we collect, use, and share information, is incorporated into these Terms. Your use of the Services is governed by this Privacy Policy. Certain Services may have additional terms, such as those for promotional programs, which will be posted with those Services. By using such Services, you agree to those additional terms.

4. Eligibility

To use the Services, you must be at least 18 years old and capable of forming legally binding contracts. Use of the Services by anyone under 13 is strictly prohibited. If you are a minor in your jurisdiction, you must have the consent of a parent or legal guardian to use the Services. If your account has been previously suspended or deactivated by Era Deals, you are prohibited from using the Services. Only human users are permitted; automated scripts, bots, or machines may not be used to access financial benefits from the Services.

5. Ownership of content

All content available through the Services, including coupons, offers, text, images, logos, advertisements, and other materials (“Content”), except for User Content, is the property of Era Deals or its licensors and is protected by copyright, trademark, and other intellectual property laws. 6. Promotions

You agree to comply with all terms associated with coupons, offers, and promotions available through the Services. Each coupon may only be redeemed once. If you print coupons using our technology, you consent to the installation of authentication and print control technologies on your devices and agree not to interfere with or circumvent these technologies. Coupons are for personal, non-commercial use only and may not be sold, bartered, or transferred.

7. Prohibited conduct

You agree not to:

• Use unauthorized software, scripts, or devices to access the Services or Content.
• Circumvent or disable security features of the Services.
• Engage in actions that damage, disable, or impair Era Deals’ systems or networks.
• Commit fraudulent or deceptive acts while using the Services.
• Gain unauthorized access to Era Deals’ systems or interfere with Services provided to others.
• Use the Services or Content for commercial purposes or create derivative works.

8. Use of the services

Subject to your compliance with these Terms, Era Deals grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, non-commercial purposes. All other rights are reserved by Era Deals or its licensors. This license terminates if you violate these Terms.

9. Use of software

Any software provided by Era Deals (“Software”) is subject to these Terms and any accompanying license agreements. Era Deals grants you a personal, non-transferable, revocable license to use the Software for non-commercial purposes, provided you do not:

• Decompile, reverse engineer, or attempt to access the Software’s source code.
• Disable or circumvent the Software’s intended operation, including authentication technologies.
• Modify or create derivative works of the Software.
• Transfer, sublicense, or redistribute the Software.

10. Service availability

Era Deals may modify the Services at any time without notice and does not guarantee availability in all locations.

11. Feedback

Any feedback, comments, or suggestions you provide about the Services (“Feedback”) becomes the sole property of Era Deals. You assign all rights in the Feedback to Era Deals and agree to assist us in securing intellectual property rights in the Feedback, without compensation.

12. Disclaimers

The Services and Content are provided “as is” and “as available.” Era Deals disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will meet your requirements, be uninterrupted, secure, or error-free, or that the Content is accurate, reliable, or safe. Reliance on any information provided through the Services is at your own risk. Era Deals is not responsible for errors in third-party data or damages resulting from your use of the Services.

13. Limitation of liability

Era Deals and its licensors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the Services, even if advised of the possibility of such damages. Our total liability for any claim related to the Services is limited to $100. Some jurisdictions may not allow certain exclusions, so these limitations may not apply to you.

14. Indemnity

You agree to indemnify and hold Era Deals, its officers, directors, employees, and affiliates harmless from any third-party claims, damages, or expenses (including attorneys’ fees) arising from your use of the Services.

15. Termination

Era Deals may, at its discretion and without notice, disclose information to third parties (including law enforcement), investigate complaints, or terminate your access to the Services if you violate these Terms.

16. Storage and limitations

Era Deals is not responsible for the deletion or failure to store information entered into the Services. We may terminate Services if your conduct violates these Terms.

17. Injunctive relief

You acknowledge that a violation of these Terms may cause irreparable harm to Era Deals. We are entitled to seek an injunction to prevent such violations, and you agree to cover our costs, including attorneys’ fees, without requiring a bond.

18. Governing law

These Terms are governed by the laws of the State of California. You and Era Deals agree to submit to the exclusive jurisdiction and venue of courts located in San Francisco, California.

19. Arbitration and class action waiver

Please read this section carefully, as it affects your legal rights.

You and Era Deals agree that these Terms affect interstate commerce and are governed by the Federal Arbitration Act. All disputes, except those related to intellectual property or small claims court, shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator has exclusive authority to resolve disputes related to these Terms, and their award is binding. Arbitration will take place in your county of residence (for U.S. residents) or in San Francisco, California (for non-U.S. residents). You waive your right to a jury trial and class action claims. You may opt out of arbitration within 30 days of the Terms’ effective date or your first use of the Services by sending written notice to: info@eradeals.com.

If you opt out, Era Deals is also not bound by arbitration. Litigation, if permitted, must be filed in federal or state courts in San Francisco, California. Claims must be brought within one year of accrual.

20. Compliance with laws

You agree to use the Services in compliance with all applicable laws and regulations, including export laws and third-party rights.

22. General

These Terms, along with referenced policies, constitute a legally enforceable agreement. If any provision is invalid, the remaining provisions remain in effect. No waiver of any breach constitutes a continuing waiver. These Terms supersede all prior agreements between you and Era Deals.

23. Copyright & trademark infringement

Era Deals responds to copyright infringement claims per the Digital Millennium Copyright Act and trademark infringement claims per our trademark policy.
